Given the wide variety of charges that fall under the umbrella of reckless driving in Virginia, it is not uncommon for people to be taken by surprise when they are charged with this Class 1 misdemeanor following seemingly minor driving misconduct. However, the penalties for reckless driving are severe and become increasingly harsh depending on the circumstances.
As Section 18.2-11 of the Code of Virginia states, Class 1 misdemeanors in Virginia are punishable by up to 12 months in jail and/or a fine of up to $2,500. According to Section 46.2-868 of the Code of Virginia, if the individual who is accused of reckless driving committed the offense while driving on a suspended or revoked license and, as a result of their reckless driving, causes the death of another, the charge is escalated to a Class 6 felony.
Felony punishments are much more strident than misdemeanor penalties. As stated in Section 18.2-10 of the Virginia Code, Class 6 felonies are punishable by one to five years in prisons and/or a fine of no more than $2,500. Further, if the suspect is accused of reckless driving while using a handheld personal communication device, there is an additional mandatory minimum fine of $250.
In addition to the criminal penalties associated with a reckless driving conviction, there are also consequences regarding your driving status in Virginia. The Virginia Department of Motor Vehicles will assess demerit points to your license and the reckless driving conviction will stay on your driving record for a certain number of years depending on the circumstances of the offense. Depending on your past indiscretions, a reckless driving conviction could carry enough points to warrant an administrative warning letter or suspension from the DMV. In most circumstances, reckless driving carries six (6) demerit points for a period of eleven (11) years.
