How Is Solicitation Defined in Virginia?

In any case involving the solicitation of prostitution, there can be a number of parties involved, including the person offering the sexual service, the person purchasing (or “soliciting”) it, and any number of individuals playing various roles in the facilitation of the act.  Under Virginia law, anyone involved in the exchange of sexual acts for money is guilty of a crime—whether that crime falls under the umbrella of “prostitution” or “solicitation.”

The crime of solicitation itself involves offering any currency, goods, or services of any value (in statute referred to as “money or its equivalent”) in exchange for sex and then taking a “substantial step in furtherance thereof.”  Under Virginia statute, a number of acts qualify as “sex,” including but not limited to:

  • Vaginal Intercourse
  • Anal Intercourse
  • Oral sex, or “fellatio”
  • Bestiality

How Is Solicitation Treated?

According to Section 18.2-346 of the Virginia Code, solicitation of prostitution is a Class 1 misdemeanor. However, soliciting a minor aged 16 or older is punishable as a Class 6 felony. Soliciting a minor under the age of 16 is punishable as a Class 5 felony.
